KVKK DISCLOSURE NOTICE

1. Identity of the Data Controller and Authorized Distributorship Information

This Disclosure Notice has been prepared by MAREAS DIŞ TİCARET LİMİTED ŞİRKETİ (the "Company"), acting as data controller, within the framework of Law No. 6698 on the Protection of Personal Data ("KVKK", Türkiye) and other relevant legislation, in order to explain the procedures and principles regarding the processing of your personal data.

Our Company is the sole and authorized distributor of the Melissa brand in Türkiye, and this authorization belongs exclusively to our Company. Infringement of the distributorship rights of the Melissa brand by unauthorized persons or organizations, unauthorized sale of products, or activities that damage the brand value are subject to legal sanctions. Our Company will pursue the necessary legal remedies to protect its rights under the Turkish Commercial Code, the Intellectual and Industrial Property Rights legislation, Industrial Property Law No. 6769, Law No. 6502 on Consumer Protection and other relevant legislation (Türkiye).

2. Purposes of Processing Personal Data and Legal Basis

Your personal data processed by our Company within the scope of this Disclosure Notice is processed for the following purposes, in line with the legal grounds set out in Articles 5 and 6 of the KVKK:

  • To conduct, develop and maintain our Company's commercial activities,
  • To ensure the protection of the distributorship rights of the Melissa brand,
  • To manage customer relations and fulfill order and sales processes,
  • To fulfill our legal obligations and respond to requests from regulatory and supervisory authorities,
  • To protect our Company's legitimate interests and take legal action,
  • To protect the brand value and initiate legal proceedings against unauthorized sellers and persons or organizations infringing the brand.

3. Methods of Collecting Personal Data and Legal Grounds

Our Company collects personal data directly from the data subject, by automatic or non-automatic means; in writing, verbally, through electronic media, the website, social media platforms, email, telephone or physical forms. This data is processed on the legal grounds of performance of a contract, fulfillment of legal obligations, protection of legitimate interests and explicit consent, as set out in Articles 5/2 and 6/2 of the KVKK.

4. Transfer of Personal Data

Pursuant to Articles 8 and 9 of the KVKK, your personal data may be transferred to the following persons and organizations:

  • Competent public institutions and organizations, in line with legal requests,
  • Lawyers, consultants, financial advisors and other relevant authorized parties, for the purpose of conducting legal proceedings,
  • Our business partners, service providers, logistics companies and suppliers, for the purpose of carrying out our business processes.

5. Legal Sanctions and Our Company's Rights

As the sole and authorized distributor of the Melissa brand in Türkiye, our Company reserves the right to take legal action in the event of infringement of its distributorship rights, unauthorized use of the brand name by unauthorized sellers, or any act that damages the brand value. Our Company has the right to initiate all kinds of criminal and civil proceedings against unauthorized activities under Industrial Property Law No. 6769, Turkish Commercial Code No. 6102 and Law No. 6502 on Consumer Protection (Türkiye).

In this context, we declare that all legal proceedings, including the prevention of unfair competition, the prevention of trademark infringement, claims for material and moral damages and the obtaining of injunctions, will be pursued against persons and organizations engaged in the unauthorized sale of products.

6. Your Rights as a Personal Data Subject

Under Article 11 of the KVKK, as data subjects you have the following rights:

  • To learn whether your personal data is being processed,
  • To request information if your personal data has been processed,
  • To learn the purpose of processing your personal data and whether it is used in accordance with that purpose,
  • To request the correction of your personal data if it has been processed incompletely or inaccurately,
  • To request the deletion or destruction of your personal data under the KVKK,
  • To request compensation for damages if you suffer damage due to the unlawful processing of your personal data.

You may submit your requests regarding the rights listed above to MAREAS DIŞ TİCARET LİMİTED ŞİRKETİ in writing or by other methods specified in the KVKK. Our Company will conclude such requests within 30 (thirty) days at the latest, in accordance with the KVKK and other relevant legislation.

7. Updates and Contact Information

This Disclosure Notice may be updated within the framework of the procedures and principles determined by the relevant legislation and regulatory authorities. Updates will take effect when published on our website.
